Judge Keeps Northwell Health Retirement Plan Fee Suit Alive

Kovner granted a request from former Northwell Health Inc. employee Kaila Gonzalez to file an amended complaint in her proposed class action lawsuit under the Employee Retirement Income Security Act (ERISA). The judge found that Gonzalez had valid ERISA claims, specifically challenging the plan’s high administrative fees of $60 per person per year and its practice of continuously offering a single emerging markets fund.

The ruling came after Gonzalez brought forth allegations that Northwell Health Inc. had mismanaged its $5.6 billion retirement plan. The company was accused of charging excessive fees and using a single mutual fund, which limited investment options for plan participants. The allegations were considered viable by the judge, who ruled in Gonzalez’s favor.
