Jury Finds Health Center Negligent in Son’s Overdose Death: Mother Files Lawsuit

Mother awarded $1.5 million after winning case against Zumbro Valley Health Center following son’s death

In 2021, Jill Adams, a mother from Red Wing, filed a lawsuit against Zumbro Valley Health Center following the death of her son Caleb Malek. The lawsuit alleged that the Rochester health center was negligent in its care and treatment of Malek, who tested positive for fentanyl, Percocet, and THC in his sober living home and sought detox treatment at Zumbro Valley Health Center.

The jury found that Zumbro Valley employees did not adhere to the policy of checking on Malek every 15 minutes, nor did they adequately screen him for drugs upon admission. Additionally, it was claimed that the health center failed to train its staff to recognize signs of a breathing problem, which may have contributed to Malek’s death.
