Tribal Nation in Kansas Leads the Way in Sports Wagering Expansion

In July 2023, the Prairie Band Potawatomie Nation became the first tribe in Kansas to complete the sports-wagering process. The Senate approved the tribe’s revised compact 27-8, and it was endorsed 93-27 in the House. Attorney Russ Brien, a member of the Iowa Tribe of Kansas and Nebraska, stated that the compact is similar to the one approved last year for the Prairie Band.

Following a landmark U.S. Supreme Court decision in Murphy v. National Collegiate Athletic Association, sports betting expanded in states and on tribal lands across the country. After years of debate, the Legislature passed a mobile and retail sports gambling bill in 2022 that was signed by Gov. Kelly. This bill applied to various state-licensed casinos, including Boot Hill Casino & Resort, Hollywood Casino at Kansas Speedway, Kansas Star Casino, and Kansas Crossing Casino.

Tribes in Kansas are allowed to participate in sports gambling on professional and collegiate events under certain conditions. However, they must follow a different procedure for regulatory approval than state-licensed casinos do. Tribal casinos interested in sports betting must request approval from the governor and engage in negotiations to amend their compact with the state government or tribal council. According to Justin Whitten, chief counsel to Gov. Kelly, this revised compact allows for in-person sports wagering on reservation land held by tribes such as the Iowa Tribe of Kansas and Nebraska. The compact also includes a trigger mechanism for potential remote online wagering from locations throughout the state.[^1]
